Understanding Utah Theft Laws

Theft in Utah is also commonly referred to as larceny. As defined under Utah Code § 76-6-404, theft is intentionally taking someone else’s property without their consent or knowledge. In order to be convicted of theft, the prosecutors must prove the intent to deprive the rightful owner of that property. The law broadly defines property as anything of value. This can also include services, such as stealing cable television or other utilities.

Theft encompasses a variety of different criminal offenses, from minor shoplifting charges to more serious crimes like grand theft auto and embezzlement. Theft charges generally fall under these two categories:

  1. Theft of property: includes personal property, real estate property, titles or certificates, trade secrets, etc.
  2. Theft of services: includes labor, professional services, utility services, transportation services, rental services, events, etc.

Utah Theft Crimes We Defend

Our criminal defense law firm near Salt Lake City defends individuals charged with the following theft crimes in Utah:

  • Aggravated burglary
  • Aggravated robbery
  • Burglary
  • Carjacking
  • Credit card theft
  • Embezzlement
  • Grand theft auto
  • Larceny
  • Robbery
  • Shoplifting (retail theft)
  • Theft of services
  • Vehicular burglary

Here’s a further explanation of the more complex forms of theft:

Burglary

You can be charged with burglary for breaking into a building with the intent to steal or commit a crime. If there wasn’t anything stolen, you could still face attempted burglary charges. If any aggravating factors are present, such as the use of a firearm or causing injury to another person, then your charge will be increased to aggravated burglary.

Embezzlement

Embezzlement is a type of property theft committed by a person in a position of trust or responsibility over those assets. Some examples include an employee stealing money from the business they work for, financial advisors taking investment money, forging checks, pocketing cash from fundraisers, selling trade secrets, and more.

Robbery

Robbery is one of the more serious types of theft crimes in Utah, as it involves a violent crime. Under Utah laws, robbery is defined as the illegal taking of property using force or threats of violence. If any aggravating factors are present, such as the use of a firearm or causing injury to another person, then your theft charge will be increased to aggravated robbery.

Shoplifting

Utah Code refers to shoplifting as retail theft, which is the act of stealing an item from a store without paying for it or intentionally paying less than its retail value. Some examples of shoplifting include taking merchandise without paying, under-ringing merchandise, switching or modifying price tags, and committing refund fraud.

Theft of Services

Theft laws in Utah apply to more than just tangible property. Theft of services is when someone avoids paying for services that require a payment through deceptive, threatening, or forceful means. Some examples include failing to pay for a meal at a restaurant, stealing cable television, refusing to pay cab drivers, or sneaking into paid events.

How Our Theft Defense Attorney Can Help You

A conviction for a theft offense can result in serious penalties, including incarceration and substantial fines. In order to avoid a conviction for a theft crime, it is important to speak with an experienced lawyer as soon as possible. At Utah Freedom Fighters, our expert theft defense attorney can assist you from the beginning of an investigation until charges are formally filed. The sooner that you talk with us, the more that can be done to build an effective defense for your case.

Our expert theft lawyer has decades of experience and extensive knowledge of the Utah laws surrounding larceny, burglary, robbery, and other theft crimes. Here are some of the ways our attorney can help you:

  • Free initial case evaluation. We’ll meet with you to review your case, provide expert legal advice on your rights, explain what steps to take next, and answer any questions you may have.
  • Investigating the evidence. We’ll investigate the facts of your case, including gathering any evidence, reviewing police reports, interviewing witnesses, and conducting other research. We will review the alleged events, investigate the situation, and determine the legitimacy of those allegations.
  • Suppressing evidence. If evidence was obtained through an illegal search without a proper search warrant, we will work to suppress that evidence. If certain evidence can’t be used in court, we can likely get your theft charges dismissed or reduced.
  • Preparing a strong defense. We’ll create a strong defense strategy and start preparing your case for trial. This includes developing legal arguments, challenging inadequate evidence found in our investigation, filing pre-trial motions, and preparing witnesses to testify.
  • Negotiating with prosecutors. As a former prosecutor, our theft defense attorney knows exactly what the prosecution is looking for. We’ll negotiate with prosecutors for better deals and reduced charges.
  • Representing you in court. We’ll provide expert legal representation at your arraignment, pretrial hearing, trial, and sentencing hearing. We are ready to defend your case in any court, present evidence in your favor, and effectively cross-examine witnesses.
  • Appealing a theft conviction. If you have been convicted of a homicide charge, the attorney can help you file an appeal with the appellate court and fight the conviction in a higher court.
